Terms and Conditions

1. About Hadiyye

Hadiyye (operated by مؤسسة فرح و هديه, "we", "our", "the Platform") is an online gifting platform that allows users to create wish-list events and collect nqoot (monetary gifts) from guests. We are based in the Hashemite Kingdom of Jordan.

By registering an account or using any part of the Platform, you ("User") agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Definitions

  • Nqoot — monetary gifts sent by event guests to an event host through the Platform.
  • Event Host — a registered user who creates an event and receives nqoot.
  • Event Guest — any person who sends nqoot to an event host via the Platform.
  • Platform Fee — Hadiyye's service charge deducted from nqoot received by the event host.
  • Nqoot Wallet — the in-platform balance held for an event host, from which they can request a payout at any time.

3. Account Registration

Anyone may register an account on Hadiyye. By creating an account you confirm that:

  • All registration information you provide is accurate and up to date.
  • You will keep your credentials confidential and notify us immediately of any unauthorised access.
  • You are responsible for all activity that occurs under your account.

Hadiyye reserves the right to suspend or terminate accounts that violate these Terms or that provide false information.

4. Platform Fee

1% + 0.100 JODBeta platform fee deducted from all nqoot received by the event host. The standard fee is 2.5% + 0.100 JOD.

For every nqoot payment collected by an event host, Hadiyye deducts a platform fee before crediting the remaining balance to the host's Nqoot Wallet. The fee covers payment processing, platform maintenance, and operational costs.

  • The standard platform fee is 2.5% + 0.100 JOD per nqoot.
  • While the Platform is in beta, early users pay a reduced fee of 1% + 0.100 JOD per nqoot. This reduced pricing applies to the beta period only and ends at general release, after which the standard fee applies.
  • The fee is calculated and deducted automatically at the time nqoot is received.
  • Guests pay the full nqoot amount — the fee is not charged to the guest.
  • The Nqoot Wallet always reflects the net amount after fee deduction.
  • The fee charged on any nqoot is shown to the guest before payment and to the host in the Nqoot Wallet.
  • Hadiyye reserves the right to adjust the platform fee with 30 days' written notice posted on the Platform.
Example: A guest sends 50 JOD. During the beta, Hadiyye deducts 0.600 JOD (1% + 0.100 JOD) and the host's wallet is credited 49.400 JOD. At the standard fee the same gift would be 1.350 JOD (2.5% + 0.100 JOD), crediting 48.650 JOD.

5. Nqoot Wallet & Payouts

Net nqoot amounts are held in your Nqoot Wallet. You may request a payout to your registered bank account at any time, subject to:

  • Your bank account details being verified and saved in your profile.
  • Any minimum withdrawal amount displayed in the Platform.
  • Standard bank processing times (typically 1–3 business days within Jordan).

Hadiyye is not a licensed bank or financial institution. We act solely as a payment facilitator and do not hold your funds longer than necessary.

6. Refunds & Disputes

Nqoot is a voluntary monetary gift. Once a guest's payment is confirmed:

  • The transaction is generally non-refundable as it constitutes a gift.
  • If a guest believes a payment was made in error or due to fraud, they must contact us at support@hadiyye.com within 7 days of the transaction date.
  • Hadiyye will review the dispute and, at its sole discretion, may reverse the transaction. Disputed amounts are placed on hold pending resolution.
  • Chargebacks initiated with a payment provider without first contacting Hadiyye may result in account suspension.

7. Data & Privacy

By using Hadiyye you consent to the collection and processing of your personal data in accordance with Jordan's Personal Data Protection Law No. 24 of 2023 and our full Privacy Policy. Data collected includes profile information, uploaded images, and — for hosts who request payouts — bank account details (encrypted at rest and in transit).

8. Prohibited Conduct

Users must not:

  • Use the Platform for any fraudulent, deceptive, or unlawful purpose.
  • Create fake events or impersonate another person.
  • Circumvent the platform fee by processing payments outside the Platform.
  • Upload content that is offensive, defamatory, or infringes third-party rights.
  • Perform automated scraping, spam, or denial-of-service attacks against the Platform.

9. Intellectual Property

All Platform content, trademarks, and software are owned by مؤسسة فرح و هديه or its licensors. Users retain ownership of content they upload (photos, event descriptions) but grant Hadiyye a non-exclusive, royalty-free licence to display and store that content for the purpose of operating the Platform.

10. Limitation of Liability

To the maximum extent permitted by Jordanian law:

  • Hadiyye is not liable for indirect, incidental, or consequential damages arising from use of the Platform.
  • Our total liability to any user shall not exceed the platform fees collected from that user in the 3 months preceding the claim.
  • We do not guarantee uninterrupted or error-free service.

11. Amendments

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Hashemite Kingdom of Jordan. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Amman, Jordan.

13. CliQ Payments

Guests may send nqoot to an event host using CliQ, Jordan's instant payment service, through our banking partner Bank al Etihad. CliQ transfers are governed by Bank al Etihad's own terms and conditions for the CliQ instant transfer service, in addition to these Terms. By sending a payment through CliQ you acknowledge and agree that:

  • Your data (full name, bank account number and/or the name of your service provider) will be shown to the recipient on their CliQ payment channels, whether they are Bank al Etihad customers or not, and regardless of which alias you use to send the transfer.
  • A one-time password (OTP) will be sent to the mobile number registered with your bank account for every CliQ transfer you make. Hadiyye never sees or requests this code.
  • If you change the mobile number registered with your bank account, your CliQ service will be suspended and any aliases linked to your old number will be permanently cancelled. You will need to re-register with your bank before you can send CliQ payments again.
  • Bank al Etihad reserves the right to terminate or amend the terms and conditions governing the CliQ instant transfer service at any time and without prior notice, independently of Hadiyye.
  • Hadiyye acts only as a payment facilitator for CliQ transfers; the transfer of funds occurs directly between your bank and Bank al Etihad.
